The borrower can only choose the subject of the loan in the manner agreed in the contract, if there is no provision in the contract, it can use it according to its nature or the purpose for which it is specific. The borrower cannot make someone else use the loan subject. In cases where the borrower acts contrary to these provisions, unexpected situations arise he is also liable for damages. However, even if they had complied with these provisions, they could not prove that harm would have arisen if he does, he gets rid of responsibility.(Article 380 of the Turkish Code of Obligations)
