IF THE CONSENT IS NOT GIVEN, IS THERE A LEGAL ACTION

The party holding the right of custody does not need a consent letter when taking the child abroad. However, in practice, some countries also seek the consent of the non-custodial party in order to secure themselves and ensure that the child is not kidnapped.

For this reason, the party with the right of custody may not receive consent from the other party for the joint child’s departure abroad. In such a case, it may be requested from the court to give a consent for the child’s departure to the country in order to avoid any problems in the child’s departure abroad. Therefore, the party with the right of custody can take the joint child abroad without the need for the consent of the other party.
