“According to article 776 of the Turkish Commercial Code; Although the maturity is one of the elements of the bond, Article 777/2 of the same Law. When an undue bond is seen in accordance with the article, it is considered a bond to be paid. According to article 704 of the same Law, which should be applied to bonds with the reference of article 778 of the Turkish Commercial Code, it is obligatory to submit the bill to be paid when seen, to be paid within one year from the issue date. In other words, since it would be necessary to accept that the bill, which does not have the maturity element, is issued as a bill to be paid when seen, as specified in Article 704 of the Turkish Commercial Code, this deficiency does not affect the bill’s qualification as a bill. The fact that the undue bond has not been presented within one year does not relieve the issuer of the bill from liability unless the statute of limitations has expired. Failure to present the deed within the term, that is, within one year from the date of issue, is considered to be overdue, and in this case, the endorsers cannot be applied for, since the right of recourse will be lost. However, unless the statute of limitations expires, the debtor’s responsibility continues.
