If the woman gives birth within 300 days after the divorce decision is finalized, the father of the child will be considered the divorced husband, according to the presumption of paternity. This presumption is valid unless proven otherwise.
If a woman becomes pregnant by another person during the waiting period, she must wait for the period of iddah in order to marry that person. Because, in order for a woman to remarry within the period of iddah, she must submit a doctor’s report proving that she is not pregnant and take a decision from the court. As a matter of fact, when the woman is pregnant, the court will not be able to make a decision to abolish the period of iddah. In this case, when the woman gives birth within the period of iddat, the father of the child born due to the presumption of paternity is considered to be the divorced spouse. When this is the case, what should be done to prevent lineage confusion would be to file a lawsuit for rejection of the lineage by the divorced spouse.
