The demand for paid military service in our country has increased significantly in recent years. As in previous years, it is expected that the military service by payment will be implemented again in the near future. The fact that the issue is on the agenda brings with it the problem of whether or not to be entitled to military service as a result of age correction lawsuits. Because, with the implementation of the practice in the recent past, people whose age did not reflect the truth in the population had problems in their applications and many of them could not benefit from the paid military service. As it is known, a certain age is determined in the paid military service application and the condition of having completed that age is sought. However, the clear regulation of our legislation reveals that changing the age after entering the military age has no effect on applying for military service. Because the regulation of Article 81 of the Military Service Law is as follows:
“Age changes made after entering the military age (except those made by the court on the basis of official hospital birth records) are not taken into account in military service. However; The head of the military service branch applies to the Public Prosecutor for the correction of the ages of those whose age and appearance are not compatible with the age recorded in the family register during the examinations, and their military service is done according to the outcome of the trial.
Among those whose age has been corrected in accordance with the first paragraph, those who have not yet entered the age of military service according to their corrected age, are recruited by taking the roll call together with their peers. Among those whose age has been corrected in accordance with the first paragraph, those who have entered the military age according to their corrected age, but have not completed the age of 23, are recruited together with their peers following their roll call. Those who have completed the age of 23 according to their corrected age are immediately sent to the class and equipment places to be determined by the Ministry of National Defense, following their roll call.
The roll call of those who have increased their age before entering the military age is made according to their changing ages.
