The Difference Between the Statute of Limitations and the Period of Decertification

In exchange for the statute of limitations granting a “right of defiance”, the periods of entitlement reduction are “objection”. Since defi is a recognized right of the debtor, like any right, the exercise of the right to defi may be waived.

In turn, since the ”appeal” creates a result that prevents the birth of a right or eliminates a right that was born, the debtor cannot renounce it.

In addition, the statute of limitations cannot be taken into account by the judge in person, unless the debtor asserts it, while the appeal and the period of reduction of rights must be taken into account directly and spontaneously by the judge.
There is no stopping or cutting of periods during the periods of entitlement reduction, as in the case of the statute of limitations. Therefore, unless the defendant makes a statute of limitations defense, the judge cannot take this into account by himself and must continue and conclude the case.
