The Italian Court of Appeal sets out the legal issue of the crime of fabricating a crime in the form of protecting the normal functioning of the criminal justice mechanisms from the danger of taking action in terms of fictitious crimes and, as a result, preventing the perversion of their institutional functions.
The Crime of Fabricating a Crime envisages two different hypotheses from a legal point of view:
First, Fabricating a Form that arises in the form of reporting a crime that is not known to have been committed to the competent authorities as if it had been committed;
Secondly, if the evidence or signs of a crime that has not been committed are fabricated in such a way as to enable an investigation, Material Fabrication comes to the agenda.
