MEASUREMENT ALİMONY

Temporary alimony is a temporary alimony, and as the name suggests, it includes a precautionary purpose. According to Article 169 of the Turkish Civil Code, when a divorce and separation lawsuit is filed, the judge ex officio takes the temporary measures necessary during the continuation of the case, especially regarding the accommodation of the spouses, their livelihoods, the management of the spouses’ property, and the care and protection of the children. As can be understood from the article of the law, temporary alimony is one of the temporary measures taken by the judge to protect the living standards of spouses and children in divorce cases.

In a divorce case, interim alimony is the monetary contribution provided by the other spouse to the care and protection of the children until the divorce decision is finalized, to the spouse who will fall into poverty before the divorce decision is made, or to the party who is left with the children as a precautionary measure. The provisional alimony ruled during the separation case continues throughout the separation decision. There is no gender discrimination in the law regarding the provisional alimony. Although the temporary alimony is mostly ruled in favor of women, there is no legal obstacle to the provision of alimony in favor of the man in case of appropriate conditions.
