With the digital revolution, the continuous updating and development of software on smart phones and computers has led to the need for legal regulation on the processing of personal information and private data. Especially in the banking, insurance and telecommunication sectors, a serious data bank is being formed regarding customers. Of course, it is the most natural right of individuals to have legal rights regarding the security and processing of their information (personal data) and to request that this information not be disclosed with spyware.

The purpose of the Law No. 6698 on the Protection of Personal Data, which entered into force on 7 April 2016, is to protect the fundamental rights and freedoms of individuals, especially the privacy of private life, and to regulate the obligations of natural and legal persons who process personal data, and the procedures and principles to be followed. Personal data can only be processed in accordance with the procedures and principles stipulated in this law and other laws.

Processing of personal data: Obtaining, recording, storing, preserving, changing, rearranging, disclosing, transferring, taking over, making available personal data by fully or partially automatic or non-automatic means provided that it is a part of any data recording system, It refers to all kinds of operations performed on data such as classification or prevention of use.

Data controller: refers to the natural or legal person who determines the purposes and means of processing personal data and is responsible for the establishment and management of the data recording system.

First and foremost, it should be noted that personal data; It can be processed with the consent of a particular subject, based on information and free will, that is, with the explicit consent of the persons.
