Goodwill is mentioned in Article 3 of the Turkish Civil Code.
However, the definition of the concept of goodwill is not included.
• However, in article 1024 of the same law, malicious person
has been defined. According to the first paragraph of this provision, “A right in rem
who knows or needs to know if it has been registered as corrupt
the third party cannot rely on this registration”. As can be seen from this provision,
a person who knows or should know about a situation is malicious, i.e.
not benevolent.
• Making the definition of goodwill based on the aforementioned provision
possible. Goodwill is a legal act that prevents the acquisition of a right.

• In other words, goodwill is an act that prevents the birth of a right.
