Effective repentance is an institution that causes personal impunity or reduction in punishment regulated in the Turkish Penal Code. Effective repentance provisions are not regulated for every type of crime in the Turkish Penal Code. Effective repentance provisions stipulated for some types of crimes are a legal institution that can only be applied in terms of the types of crime for which they are regulated, in accordance with the principle of legality. In Article 192 of the Turkish Penal Code, effective repentance provisions are regulated for the crime of manufacturing and trading drugs or stimulants.
According to the aforementioned law, if the person who has participated in the crimes of drug or stimulant production and trafficking informs the authority of the other accomplices and the places where the drugs or stimulant substances are stored or manufactured, before the official authorities are informed, the information given may prevent the accomplices of the crime or the drug or if he leads the seizure of the stimulant substance, no penalty shall be imposed on him.
