DISCLAIMER PERIOD

The duration of the refusal inheritance is regulated in article 606 of the Turkish Civil Code. According to this article, the inheritance can be rejected within three months. This period is for the legal heirs, unless it is proved that they later learned that they are heirs, that they learned about the death of the inheritor; For heirs appointed by will, it starts to run from the date when the disposition of the legator is officially notified to them. Within the scope of this article, it is necessary to request the rejection of the inheritance within three months following the death of the inheritor or the heir learning that he is the heir. This refusal request is examined without the discretion of the Magistrate.

According to article 615 of the Turkish civil code, which is titled as the extension of the rejection period; “In the presence of important reasons, the magistrate may extend the refusal period granted to the legal and appointed heirs or grant a new period.”

These periods are valid in the actual rejection of the inheritance. In case of legal refusal, after the death of the inheritor, they can always request the determination of the insolvency of the legator on the date of death. In addition, the heirs will be able to request this determination from the Civil Court of First Instance.
