The crime of insulting the President is specifically regulated in the section of Crimes Against the Sovereignty of the State and the Dignity of Its Organs in Article 299 of the Turkish Penal Code. It appears as a separate regulation from the offense of insult, which is generally regulated in the section of Offenses Against Honor in article 125 of the Turkish Penal Code.
Regarding the occurrence of the crime of insulting the President, the Supreme Court of Appeals should attribute or attribute “acts or adjectives that shock his or the society’s thoughts or feelings about his social value” for the formation of this crime. What kind of actions are violating honor and reputation should be determined according to the average thinking and understanding prevailing in the society, the criterion in determining this is not the individual’s special sensitivity. In this respect, a simple disrespect cannot be described as insulting and cursing”.
