There is no legal regulation in our law that obliges enforcement proceedings with a single and the same file for receivables under the same writ. However, there is no provision in the law regarding the right to be followed separately with regard to the rights enshrined in a writ.
abuse of right; It is the use of a right by going beyond the limits of a legally existing right or by justifying that right, as a situation of committing unlawful acts, or by deviating from its purpose, even though it is within the limits of the powers recognized by the law. Although the judgment is a whole, the creditor’s initiating two separate proceedings based on the same judgment, without a legal and valid reason, in a way that will cause the debtor to suffer a loss, is within the scope of a clear abuse of the right.
In this case, since there is no regulation in the law regarding the right to be followed separately with regard to the rights enshrined in a verdict, the judge has to fill the gap in the law within objective good faith rules, in accordance with the above-mentioned articles of law.
