As can be seen in the Turkish Civil Code, the nullity of marriage is also divided into absolute and relative. Although there are some differences between these two types of butlan, the result of both is the same, that is, the termination of the marriage.
In Terms of Reasons: Although the cause in absolute nullity is public interest, in relative nullity the cause is the private interest of those concerned.
In terms of the Claimants: Since there is public interest and public order protected in absolute nullity, the case of absolute nullity can be brought forward not only by the spouses, but also by the public prosecutor or those concerned, and a lawsuit can be filed. However, the right to file a relative nullity lawsuit only belongs to spouses and legal representatives.
In Terms of Duration: Although it can always be claimed because absolute nullity is related to public order, we are talking about six-month and five-year disqualification periods in terms of relative nullity.
